if i have a contract with individual "A", and individual "A" breaks/doesn't meet one (or more) of the clauses of the contract, can the contract be considered void after that???
i know it's kinda vague ... but I'm not exactly savvy when it comes to this kinda stuff ... say "john" is supposed to give me 5 marbles every friday ... and its monday and he hasn't even given me one, can i consider the contract voided and start a new contract with another person???

To put it simply if the terms of the contract as stated are not met then yes there is a breach of contract. However, it depends. Are there any other clauses etc. You have to be more specific, example would be rent. The contract may state that rent is to be paid on the 1st of the month but provincial or state laws may allow a few days leeway. So it really depends on the contract, specific clauses and the laws where you live if applicable.

uhhhh, it can really, really depend on the kind of contract... if it's rent, there is more you have to go through and can vary depending on state.
You wouldn't happen to have put in the contract what would happen if the obligations of the contract were not met, would you?

no, it's not rent ... i'm contracting with a company and i'm getting screwed, but i can't change contracting companies (that's one of the clauses), but since they're supposed to pay me (stated on the contract) at the latest every 14 days, and they haven't, according to me they've breached the contract, thus, i can consider the contract null, and therefore go with a better company ... IMO ... but i'm a network engineer, not a lawyer, so i'm not really sure if it's that simple.
... i guess i should've just simply stated that to start with ... /forum/images/graemlins/smirk.gif ... so its not really marbles i'm fighting for ... /forum/images/graemlins/grin.gif

Regardless, I'd inform them that they're in breach of contract. How long after you end your contract with that company are you allowed to sign up with a new one. One I dealt with said 6 months, but that was part of the contract.
Does it really not say what would happen if the terms of the contract were not met?

???? don't really know, i'm going through it ... i haven't seen a clause where it states what happens if the contract is breached ... i'm assuming everything is nullified and i can get another company ASAP ....

Never assume anything.
Nutmeg gave you a very wise advice. Inform them that they are in breach of the contract and tell them what you intend to do. See what they say.

oh yeah! i'm not going straight to another company ... i'm already talking to them, but i want out ... and they know this ...
